Terms and Conditions

You understand that you have met Advanced Loan System LLC's ("ALS") prequalification guidelines. While our willingness to proceed with your loan request indicates that we are optimistic about your chances for receiving loan approval, you also understand and agree that (i) ALS has relationships with multiple unsecured lending partners; (ii) we offer no guarantee that you will be approved by our recommended lender for all or part of the initial loan amount you requested; (iii) all decisions including, but not limited to, the loan's approval, amounts, interest rates, terms and disclosures will be offered directly to you by the lender, not ALS; (iv) the lender may offer you a fixed, closed-end or revolving loan; (v) ALS will provide your contact information to the lender who is then authorized to contact you; (vi) the lender may obtain your credit report to make a final decision; and (vii) the lender may share with ALS, to the extent permitted by law, certain information about you, your account and your credit experience with them.

You appoint ALS as your special and limited attorney in fact to represent you in the loan application and verification process, either electronically, verbally, written or otherwise. You agree to hold ALS harmless from any misstatements. You understand that depending upon the nature of your loan request, and other possible factors, financing may be approved in your personal and/or business name, and you agree that you will accept your loan proceeds as long as your approved loan terms are acceptable to you.

Indemnity

As a condition of use of the Websites and/or ALS's services, you agree to indemnify ALS and its suppliers, Lending Partners, Providers against any and all liabilities, expenses (including attorneys' fees) and damages arising out of claims resulting from your use of the Websites, including without limitation any claims alleging facts that if true would constitute a breach by you of this Agreement.

Limitation of Liability

YOU UNDERSTAND AND AGREE THAT ALS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES RESULTING FROM OR IN ANY WAY CONNECTED TO YOUR ACCESS TO, USE, INABILITY TO USE, OR RELIANCE ON THE WEB SITE OR ANY PRODUCTS OR SERVICES OBTAINED THROUGH THE WEB SITE. NOTWITHSTANDING ANY OTHER PROVISION OF THESE TERMS OF USE, ALS'S ENTIRE LIABILITY TO YOU SHALL NOT EXCEED $1,000. FOR THOSE JURISDICTIONS THAT EITHER DO NOT ALLOW OR PLACE RESTRICTIONS UPON THE EXCLUSION OR LIMITATION OF DAMAGES IN CERTAIN TYPES OF AGREEMENTS, THIS LIMITATION SHALL BE CONSTRUED TO PERMIT THE MAXIMUM EXCLUSION OR LIMITATION PERMITTED BY APPLICABLE LAW.

Disclosures

Depending on which lender is chosen for your particular situation, the following may apply: By submitting this application, you acknowledge and agree to the following: You are at least 18 years of age or at least 21 years of age if a permanent resident of Puerto Rico. Our ("Lender or Lending Partners") may obtain a credit report about you from a creditreporting agency to process your application, service your account, and manage its relationship with you. The Lender and its affiliates may share certain information regarding this application and this account. The Lender may also share with ALS and with others, to the extent permitted by law, certain information about you, your account and its credit experience with you. Upon the opening of your account, you may indicate a preference to exempt the account from some of this information sharing. Your Account Agreement, which includes an arbitration provision, will govern your account relationship. You will be responsible for all charges incurred under the terms of your Account Agreement. If you have responded to any offer of credit from the Lender in the past 30 days, this application may be considered a duplicate. So that the Lender's credit analyst can make a decision, we must have your authorization to submit this application to the Lender. By allowing us to proceed with your loan request, you agree to all of the disclosures above.

Acceptance

By clicking submit, you are allowing us to proceed with your loan request and you acknowledge you have read the above Terms of Service, Indemnity, Limitation of Liability and Disclosures and that you accept them in their entirety.

Opt-Out

You may remove your information from our database. If you remove your information from our database it will no longer be used by us for secondary purposes, disclosed to third parties, or used by us or third parties to send promotional correspondence to you. You may remove your information by sending your request in writing via email to info@americaoneunsecured.com.

FCRA DISCLOSURE

The federal Fair Credit Reporting Act ("FCRA") allows you to obtain from each consumer reporting agency a disclosure of all the information in your credit file at the time of the request. Full disclosure of information in your file maintained by a consumer reporting agency must be obtained directly from such consumer reporting agency. The credit reports provided or requested through our Marketing Partners are not intended to constitute the disclosure of information by a consumer reporting agency as required by FCRA or similar laws.

Under FCRA, you are entitled to receive an annual free disclosure of your credit report from each of the national consumer reporting agencies. To request your free annual report under FCRA, you must go to www.annualcreditreport.com. You can also request this free annual disclosure by calling toll-free (877) 322-8228 or by using the mail request form available at the website set forth above.

You are entitled to receive a free copy of your credit report from a consumer reporting agency if:
    1. You have been denied or were otherwise notified of adverse action related to credit, insurance, employment, or a government granted license or other government granted benefit within the past sixty (60) days based on information in a credit report provided by such agency.
    2. Your application for rental housing has been denied or you were required to pay a higher deposit than usually required within the past sixty (60) days based on information in a credit report provided by such agency.;
    3. You certify in writing that you are unemployed and intend to apply for employment during the sixty (60) day period beginning on the date on which you made such certification.
    4. You certify in writing that you are a recipient of public welfare assistance.
    5. You certify in writing that you have reason to believe that your file at such consumer reporting agency contains inaccurate information due to fraud.

Communication and Verification

To help the government fight the funding of terrorism and money laundering activities, federal law requires all financial institutions to obtain, verify and record information that identifies every customer. What this means for you: When you apply for a loan, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your drivers license or other identifying documents.
