AFFILIATE ASSURANCE OF COMPLIANCE

  1. The undersigned individual is an executive Officer of 1800MYMONEY LLC dba AmericaOneUnsecured.com ("Affiliate") and has the authority on behalf of Affiliate to provide this Assurance.

  2. Affiliate complies with any and all applicable local, state or federal laws, rules and regulations (collectively the "Applicable Laws") pertaining to its activities undertaken pursuant to all agreements between Affiliate and The Credit Pros.

  3. Affiliate agrees to obtain prior express written consent on its own behalf and on behalf of Success Systems LLC dba The Credit Pros (hereinafter The Credit Pros) and/or any specified designees before making all autodialed and/or pre-recorded calls or texts that are sent or made to cell phones on behalf of The Credit Pros or for its benefit; and for pre-recorded calls made to residential land lines for any purposes on behalf of The Credit Pros or for its benefit.

  4. Affiliate agrees that any request for consent from consumers that will allow Affiliate and The Credit Pros to make autodialed and/or pre-recorded calls or texts that are sent or made to a wireless telephone for marketing purposes or a pre-recorded call made to a residential land line for marketing purposes, will give consumer a CLEAR AND CONSPICIOUS DISCLOSURE that consumer will receive future calls that deliver autodialed and/or pre-recorded telemarketing messages on behalf of The Credit Pros and/or any specified designees; that consumer's consent is not a condition of purchase; and that consumer must designate a phone number at which to be reached.

  5. Affiliate agrees that prior Express Written Consent for all auto-dialed calls, text/SMS messages and prerecorded calls must include, but not be limited to, a clearly and conspicuously placed disclosure (for example, not simply in a terms weblink, but also directly on the homepage or lead collection page of the website in close proximity and readable font to the lead entry point) that the consumer who is submitting their information agrees and consents to receive return telephone calls through the use of an autodialer or prerecorded message or text/SMS (as appropriate) from Affiliate and the Credit Pros, and that consent to receive such calls "does not obligate the consumer to purchase". The consent must be affirmatively consented to, such as through the use of an open-checkbox or other means that demonstrates express consent based on clear and conspicuous disclosures, and a screenshot and IP address (or other recordable proof) that is provided to The Credit Pros and maintained for at least four years in an easily searchable format. Affiliate acknowledges and understands that consumers may revoke their consent to receive autodialer initiated calls by and through reasonable means at reasonable times; in the event a consumer elects to revoke said consent, Affiliate will remove consumer name and number from their system and place said consumer on Affiliate's internal Do Not Call List.

  6. Affiliate shall display in immediate proximity to any landing page and electronic lead slip or other consumer data-gathering method, a clear disclosure advising consumers that by entering information in the electronic promotion, the consumer "expressly requests" to receive a return telephone call from Affiliate and The Credit Pros related to its products and services. The disclosure must be displayed clearly and conspicuously, on both electronic lead slips and in all other lead generation conducted by Affiliate. All websites must have accurate and current terms and conditions as well as privacy policies consistent with federal law. They must also contain full customer service contact information.

  7. Affiliate complies with the federal CAN-SPAM law1, state marketing counterparts, state and federal trade practice rules, and all Federal Trade Commission Guidelines relating to internet and email marketing.

  8. Affiliate agrees to modify all relevant marketing and advertising campaigns, to ensure that the consumer receives clear and conspicuous disclosures prior to effectuating Express Written Consent to receive autodialed calls at the number provided by the consumer and that data/message rates may apply. To the extent that Affiliate will be sending text/SMS messages after receiving the appropriate opt-in, it will identify the sender at the inception of a message and provide a means of opting out.

  9. Affiliate further agrees that it will provide interactive opt-out mechanisms which will be announced at the onset of any pre-recorded or autodialed message, and that such will be available throughout the duration of the call, and further that Affiliate will keep and maintain records of "abandoned calls" and average no more than 3% of "abandoned calls" for each advertising or marketing campaign over a given thirty (30) day period. Affiliate will strictly comply with all other requirements of the TCPA, including but not limited to the prohibition against transmitting pre-rerecorded audio or text messages to consumers without first obtaining their express written consent in a manner satisfactory and pre-approved in writing by The Credit Pros.

  10. Prior to making any outbound telemarketing phone call pursuant to the Agreement, Affiliate scrubs its telemarketing database against any applicable Do Not Call list.

  11. Affiliate acknowledges and understands that the Telemarketing Sales Rule ("TSR") prohibits deceptive and abusive telemarketing acts and practices and sets forth standards of conduct for telemarketing calls. Affiliate will comply with the TSR requirements; specifically noting:

    1. Calling times are restricted to the hours between 8 a.m. and 9 p.m.
    2. Affiliates must promptly advise the consumer of the identity of the seller and that the call is a sales call.
    3. Affiliates must disclose all material information about the goods or services they are offering and the terms of the sale. They are prohibited from lying about any terms of their offer.
  12. Affiliate further complies with the applicable laws by: (a) ensuring that it does not place telemarketing phone calls to wireless telephone numbers in violation of the applicable laws; (b) maintaining an internal do not call list in compliance with the applicable laws; (c) ensuring that abandoned calls, if any, fall within the requirements of the amended TSR or other of the applicable laws; (d) maintaining a written do not call policy, which includes but is not limited to training for each telemarketing agent to comply with the requirements of the applicable laws and which is available to The Credit Pros upon request and (e) ensuring that if a consumer phone number has been reassigned, Affiliate will stop calling that number after one call and receipt of the information that the number was reassigned.

  13. The undersigned executive Officer of Affiliate has been properly authorized by Affiliate to provide this Assurance to The Credit Pros.


1 Without limitations, compliance with CAN-SPAM laws includes:
  1. Subject line must be accurate and not deceptive
  2. Text of email must be accurate and not deceptive
  3. Body of email must contain sending company's name and physical address. (no PO Boxes)
  4. Body of email must have a working opt-out link, to easily allow opt-out. (Affiliate may email market anyone or any company until they opt-out or request (in any manner) that Affiliate stops.)
  5. Affiliate cannot use IP address tricks, deviations (meaning routing the email throughmultiple servers to hide or avoid spam blockers), or flooding a company or person with emails to be harassing.
